TERMS AND CONDITIONS OF SERVICE

1. Provider Identification

Trancas Experiences is a tourist transportation and experience coordination operator based in the Ñuble Region, Chile.

By booking or using our services, the user declares that they have read, understood, and accepted these Terms and Conditions.


2. Nature of the Service

Trancas Experiences provides the following services:

  • Private tourist transportation.
  • Airport – mountain – coast transfers.
  • Mobility to ski resorts and tourist destinations.
  • Coordination of experiences and activities with third-party providers.

Trancas Experiences does not act as a traditional travel agency unless expressly stated. It operates as a logistics operator and direct transportation provider, and may coordinate services provided by third parties.


3. Booking Process

Bookings:

  • Are subject to availability.
  • Must be confirmed in writing, either by email or digital communication.
  • May require advance payment in order to be confirmed.

A booking is not considered confirmed until the client receives formal confirmation.


4. Payments

To confirm a booking, an advance payment may be required, either partial or full.

The remaining balance must be paid before or at the time of the service, as indicated in the booking confirmation.

If payment is not received within the established deadline, the booking may be automatically cancelled.


5. Cancellations and Rescheduling

Cancellation by the client:

  • Cancellations must be requested in writing.
  • Refunds will be subject to the conditions informed at the time of booking.
  • During high season, more restrictive policies may apply.

No Show:

If the client does not arrive at the agreed meeting point without reasonable prior notice, no refund will be issued.

Rescheduling:

Rescheduling may be possible, subject to availability and operational conditions.


6. Weather Conditions and Road Status

The client acknowledges that:

  • Services in mountain areas are subject to weather conditions.
  • Snowfall, ice, road closures, or authority regulations may affect the service.
  • In cases of force majeure or unsafe conditions, Trancas Experiences may modify, reschedule, or suspend the service for safety reasons.

It shall not be considered a breach of contract when modifications are due to external causes, weather conditions, or authority regulations.


7. Provider Responsibility

Trancas Experiences undertakes to:

  • Operate with vehicles in proper technical condition.
  • Maintain the insurance required under Chilean regulations.
  • Comply with current legislation applicable to passenger transportation.

However:

  • Trancas Experiences shall not be responsible for delays caused by traffic, third-party accidents, extreme weather conditions, or road closures.
  • Trancas Experiences shall not be responsible for indirect losses, loss of profit, or consequential damages.

8. Luggage and Personal Belongings

Each passenger is responsible for their personal belongings.

Trancas Experiences shall not be responsible for:

  • Loss of items left behind in the vehicle.
  • Damage to luggage not attributable to proven direct negligence by the operator.

9. Passenger Conduct

Passengers must:

  • Maintain respectful conduct.
  • Comply with safety regulations.
  • Use their seat belt.

The provider may refuse or suspend the service if the passenger’s behavior compromises the safety of the driver or third parties.


10. Third-Party Services

When Trancas Experiences coordinates activities or services provided by third parties, such as hotels, vineyards, tourism operators, or other providers:

  • Direct responsibility for the execution of the service lies with the corresponding provider.
  • Trancas Experiences acts as a logistics intermediary unless otherwise stated.

11. Limitation of Liability

Under no circumstances shall the total liability of Trancas Experiences exceed the amount actually paid for the contracted service.


12. Force Majeure

It shall not be considered a breach of contract when the service cannot be performed due to causes beyond the reasonable control of the provider, including:

  • Natural disasters.
  • Extreme weather conditions.
  • Acts of authority.
  • Health emergencies.
  • Social conflicts.

13. Jurisdiction and Applicable Law

These Terms and Conditions are governed by the laws of the Republic of Chile.

Any dispute shall be submitted to the competent courts in Chile.

In the case of international users, use of the website implies acceptance of Chilean jurisdiction.


14. Modifications

Trancas Experiences reserves the right to modify these terms whenever necessary.
